These General Conditions of Sale have as their object the purchase of products made remotely via the telematic network on the website www.soundsound.store belonging to our company SMARTTEK Società a Responsabilità Limitata Semplificata (SRLS), with headquarters in Contrada Calice SNC in Canicattì (AG) - VAT number: 03086740846. Each purchase transaction will be governed by the provisions of the law in force according to the Italian civil code, as well as the information aimed at the conclusion of the contract and the protection of confidentiality.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The sales contracts of the products on our website are considered concluded when the purchase order made by the customer is received and the latter accepts it. Our website will promptly send the customer a receipt of the purchase order. By electronically sending his/her purchase order, the customer declares that he/she has read and accepted these general conditions of contract and undertakes to observe and respect them in his/her relations with our company.

PROCESSING OF PERSONAL DATA

Pursuant to art. 13 of Legislative Decree 196/2003, we inform you that the personal data, including personal and fiscal data, acquired verbally in reference to the established commercial relationships, provided directly by the interested parties, or otherwise acquired in the context of the company's activity, will be processed in compliance with the aforementioned legislation, including the confidentiality obligations provided for by them in relation to the aforementioned, the rights referred to in Article 7 of Legislative Decree 196/2003 may be exercised.

CUSTOMER OBLIGATIONS

The Customer is required, before sending his/her purchase order, to carefully read these general conditions of sale. Sending the purchase order implies their full knowledge and acceptance. Finally, once the online purchase procedure has been concluded, the Customer is required to print and keep these general conditions of sale, already viewed and accepted during the contract conclusion phase.

ORDER DEFINITION

By sending the online order,the Customer sends our company a proposal to purchase the product and/or products placed in the cart. When the Customer places an online order for the products placed in the cart, he agrees to purchase them at the price and terms indicated in these General Terms and Conditions of Sale.

Our website will communicate to the Customer the acceptance and confirmation of the order.

PURCHASE METHODS

The customer purchases the product, whose characteristics are illustrated online in the relevant descriptive and technical sheets, at the price indicated therein to which are added the delivery costs specified on the site. Before sending the purchase order, the unit cost of each chosen product is summarised, the overall cost in the case of purchasing multiple products and the relevant delivery costs. Once the purchase order has been sent, the customer will receive an email from our website confirming receipt of the purchase order and containing information on the main characteristics of the purchased item, detailed information on the price, delivery costs, applicable taxes and payment methods and containing a reference to the general contract conditions and information on the existence of the right of withdrawal, the conditions and methods of exercising it displayed on the site. We undertake to respect the timeframes indicated on our website and/or communicated via email, however, they must be considered indicative and, therefore, may vary without notice. In the case of an order of products not available in stock, the validity period of the order can be extended up to a maximum of one year from the date of payment of the order, after which the order will be closed and refunded in full.

PAYMENT METHODS

BANK TRANSFER

This is a widely used method, thanks also to the possibility of making the payment directly online and in many cases without charges. The order will be processed only after receipt of payment (it takes 0 to 2 days from execution). For urgent orders we recommend making an instant bank transfer. The details for making the payment will be provided during the purchase process and at the end of the purchase process in the order summary email, and if you do not receive it, check your spam folder.

DELIVERY OF PRODUCTS

Shipping and Delivery

Processing and Delivery Time:

Dear customers, please note that the estimated total delivery times to the customer's address or to a pickup location are calculated based on the Processing Time and the Transit Time.

- Processing Time applies to all orders, including those containing customized items or requiring assembly, and takes 1 to 2 business days (Monday to Friday). Processing time is the difference between the cut-off time for accepting an order and the time the order is ready for transit (handover to the carrier).

- Transit Time takes 1 to 4 business days (Monday to Friday). Transit time is the time it takes for the carrier to deliver a product to a customer.

Estimated total delivery times to the customer's address or to a pickup location will take 2 to 6 business days (Monday to Friday).

The order cut-off time is 2:00 PM (GMT+01:00) Central European Standard Time (Rome), and estimated delivery times are calculated based on the time the order was placed (before or after the cut-off time) and the specified Processing Time and Transit Time. If delivery falls on a holiday, the estimate will be adjusted accordingly.

We would like to point out that business days are Monday through Friday (excluding Saturdays, Sundays, and holidays).

Shipping Method (couriers assigned to manage the shipment):

Packages are shipped to the shipping address specified by the customer when placing their order in our online store, and at our discretion via UPS, Fedex, etc. Any specific requirements regarding shipping, courier selection, or additional paid services must be requested by the customer from our company before placing an order and paying.

Shipping Costs:

We currently ship worldwide. All our packages are insured. Shipping is free and includes handling, packaging, and insurance. The minimum order value required for acceptance is €23.78 excluding VAT, or €29.01 including VAT (this value in euros will be converted into the other currencies you select).

Customs:

Product prices include taxes and customs duties. For countries outside the EU, we handle the customs declaration, so you will not have to pay any customs duties. Please note that shipping times may be affected by certain holidays, bank holidays, or customs delays. We appreciate your understanding!

Packaging:

Special care is taken with fragile items. The boxes are adequately sized and your items will be well protected.

During delivery:

If you encounter any problems during delivery, please note "WRITTEN RESERVATION" and describe the reason directly on the courier's delivery note (e.g., accepted with reservations for an open package, a sealed package, a package sealed with plain tape without a company logo, missing package, crushed packages, a broken package, or a torn cardboard box, etc.). Please remember that if you sign for the package without contesting any obvious damage or discrepancies, the courier is released from all liability for damage incurred during transport. If the recipient is absent at the shipping address indicated on the order, the courier will leave a note and try again. If the recipient is still absent, the goods will be returned to the sender. You will find the invoice, receipt, or tax discount inside the package. If you lose your sales document, you can request a PDF copy from customer service by email. Alternatively, you can download the sales document directly from your account in the "Orders" section.

ORDER CANCELLATION

Purchase orders are immediately binding and binding for the buyer and can be canceled unless accepted by customer service by contacting customer service via written communication to be sent by e-mail. For orders already processed, the customer must exercise the Right of Withdrawal.

Attention: Sending a simple communication is not enough to deem the order null and void, but rather you must receive a written confirmation via email from our customer service.

It is possible to check the status of the shipment online by accessing the site with your e-mail and password in the "My Account" section "Orders".

GUARANTEE OF CONFORMITY AND DEFECTIVE PRODUCTS

Below is the Italian legislation on warranty rights.

All products sold are covered by the guarantee of conformity referred to in articles 128 and following of Legislative Decree no. 206/2005 (Consumer Code) Therefore for any lack of conformity that occurs within the period of 2 years from delivery of the product marked as NEW. The term is 2 years for products marked as EX-DEMO and 12 months for products marked as USED.

The consumer loses the warranty if he fails to report the defect to the seller within two months of discovery. The defect concerns the lack of conformity of the purchased product and refers to the integrity and functionality of the same, given the conditions described on the site (for example, "new", "ex-demo" or "used"). This regulation is applicable with exclusive reference to buyers who qualify as "consumers" pursuant to art. 3 of the aforementioned Legislative Decree (natural persons who purchase for purposes unrelated to their professional or entrepreneurial activity).

For used products, the validity of the warranty is reduced to one year from delivery, unless otherwise specified. For buyers who do not fall into the category of consumers, who usually purchase with a VAT number, the legal guarantees referred to in articles 1490 et seq. of the Civil Code will apply. (one year under the legal conditions).

GUARANTEE CONDITIONS

- the product warranty covers labor costs and the replacement of all factory defective parts, excluding damage caused by improper use of the product,

- any interventions carried out by unauthorized Service Centres, as well as the alteration of the original plates or the cancellation of the Serial number (even partial), will automatically void any warranty rights,

- the appliance requiring assistance must always be delivered or sent carriage free together with a copy of the Warranty Validation Request and the receipt,

- We are not liable for damage caused to the product during transport, the buyer must ensure that the packaging is adequate and able to protect the product from breakages and impacts resulting from transport itself,

- the warranty does not cover damage resulting from: carelessness and negligence, incorrect and improper use of the product, any damage resulting from the use of the product with power supply voltages other than that indicated, any damage resulting from modifications made to the appliance on both the electrical and aesthetic parts,

- we decline all liability for any damage that may, directly or indirectly, be caused to people, things or animals as a result of failure to observe the instructions indicated in the specific operating manuals and concerning the warnings regarding INSTALLATION, USE AND MAINTENANCE OF THE APPLIANCE,

- the use of the appliance outside of normal safety conditions releases us from any civil or criminal liability,

- any damage caused by lightning, fire, force majeure of any kind excludes any liability on our part,

- We are not liable for damages arising and consequent to the failure of the appliance, thus excluding any compensation in favor of the purchaser.

- any technical or aesthetic modifications, any improvements to the product, which may be implemented over time, do not oblige us to modify even the appliances already produced previously.

EXERCISE OF THE RIGHT OF WITHDRAWAL

Exceptions

If you return an item, you will be refunded the payment you made within 14 days of the return shipment, including the costs of both outgoing and return shipping. The refund will be made using the same payment method used for the initial transaction, unless otherwise specified by the customer.

EXPRESS TERMINATION CLAUSE

In the event of total or partial non-payment of the purchase price of the goods, we reserve the right to declare this contract terminated pursuant to and for the purposes of art. 1456 of the civil code by sending a written communication to the customer's email address.

COMPLAINTS

In the event of any complaints, the customer must send a written message to our email address.

We will consider the complaint within 3 days of receipt and will send a response to the customer by email.

APPLICABLE LAW AND JURISDICTION

All disputes arising from this contract will be referred to a conciliation attempt at the Mediation Body of the Chamber of Commerce of Agrigento and resolved according to the Conciliation Rules adopted by the same.

If the Parties intend to appeal to the ordinary Judicial Authority, the competent Court is that of Agrigento.

REFERENCE

This contract is governed by Italian law.

For anything not expressly provided for herein, the provisions of law applicable to the relationships and cases provided for in this contract shall apply.
